Terms & Conditions of Use

1. Identification of the owner

BeatPlay is an app published on the Apple App Store. The owner and developer is Bagel Affairs, based in Barcelona, Spain. For any legal questions you can write to [email protected].

2. Nature of BeatPlay

BeatPlay is a local audio player application for iOS, iPhone and Apple Watch. Its purpose is to allow the user to play audio files stored locally on their device or incorporated into the App through mechanisms permitted by iOS.

3. No content provided by BeatPlay

BeatPlay does not include a music catalog, library of works, third-party generated content, download links, music search or file exchange features. The developer does not select, review or control the audio files played by the user.

4. App license

The developer grants the user a limited, revocable, non-exclusive, non-sublicensable, non-transferable, worldwide license to download, install and use BeatPlay on iOS devices owned or controlled by the user, in accordance with these Terms and the applicable Apple App Store conditions.

5. Permitted use

The user may use BeatPlay exclusively to play local audio files whose use is lawful in accordance with applicable law, licenses, authorizations or legal limits that apply.

6. Prohibited uses

It is prohibited to use BeatPlay to play illegally obtained files, infringe intellectual property rights, circumvent protection measures, distribute protected works without authorization, reverse engineer, modify the App or use it fraudulently or unlawfully.

7. Responsibility for files and copyright

The user is solely responsible for the audio files they incorporate, keep or play through the App, as well as for obtaining the necessary authorizations, licenses or rights for their use. The developer is not responsible for the origin, ownership, legality or content of such files.

8. Use by minors

BeatPlay is designed as an app suitable for all audiences. Minors may use the App under the supervision and authorization of their parents, guardians or legal representatives when required by applicable law.

9. Device permissions

To function properly, BeatPlay may request permissions to access local files, media library, audio playback, background playback, notifications and local storage. These permissions are used exclusively to provide the requested features.

10. In-App Purchases and subscriptions

BeatPlay may offer free and paid features. All payments, billing, renewal, cancellation and subscription management are processed exclusively through the Apple App Store. Uninstalling the App does not automatically cancel an active subscription.

11. Privacy and personal data

BeatPlay works locally and offline. The App does not upload, analyze, share or store audio files, local playlists or listening habits on external servers, unless expressly stated in the Privacy Policy.

12. Third-party software and audio formats

The App may use third-party or operating system components, APIs, frameworks or libraries to enable audio playback, management or display features. Format compatibility may depend on iOS and device capabilities.

13. Updates and compatibility

The developer may publish updates to fix bugs, improve features, adapt the App to new iOS versions or strengthen security. Compatibility with all devices or older iOS versions is not guaranteed indefinitely.

14. Backups and local files

BeatPlay is not a file storage, backup, synchronization or recovery service. The user is responsible for keeping backups of their audio files and any local data they consider important.

15. Legal warranties and limitation of liability

BeatPlay is provided according to the described features. The developer will endeavor to keep the App operational, secure and compatible, without guaranteeing uninterrupted, error-free operation or compatibility with all devices, accessories, formats or files.

16. Apple App Store

These Terms are entered into between the user and the developer, not Apple. Apple is not responsible for BeatPlay or its content, maintenance or support, except as required by applicable law or the Apple App Store terms.

17. Suspension and termination

The user may stop using BeatPlay and uninstall it at any time. The developer may suspend or revoke the license if the user materially breaches these Terms, uses the App fraudulently or unlawfully, or infringes third-party rights.

18. Changes to the Terms

The developer may modify these Terms to reflect legal, technical, operational or commercial changes. When changes are material, the user will be informed through the App, App Store, legal website or any other reasonable means available.

19. Claims

The user may direct queries, incidents or claims to the legal contact indicated in these Terms. If acting as a consumer, you may go to consumer bodies and alternative dispute resolution mechanisms applicable.

20. Applicable law and jurisdiction

These Terms are governed by Spanish law and by the applicable European Union legislation. If the user acts as a consumer, any dispute shall be submitted to the competent courts in accordance with consumer regulations.

21. General provisions

These Terms, together with the Privacy Policy and applicable third-party software legal notices, constitute the agreement between the user and the developer regarding the use of BeatPlay.
